Samuel Davenport, Libertarian candidate for the 2nd District congressional seat, stays on the ballot

Libertarian candidate Samuel Davenport overcame a second effort to disqualify himfrom the 2nd Congressional District race Tuesday. The 4th Circuit Court of Appeal ruled8-3 that the challenge to his candidacy, filed by Eliza Eugene and Lawrence Galle, had no legal merit, affirming the decision of Civil District Court Judge Lynn Luker.

Davenport greeted the ruling with jubilation and a challenge to incumbent Cedric Richmond, D-New Orleans. "My opponent, instead of trying to bully himself an election, should just let the people decide," he said. He encouraged his supporters to help him win another victory, this one at the ballot box on Nov. 4.

Ike Spears, a Richmond ally and the lawyer who argued on behalf of Eugene and Galle during the appeal, did not immediately return a message left at his office.

Eugene and Galle's objection to Davenport's candidacy was made predominantly on the grounds that Davenport filled out the wrong address on his forms to register for the ballot.Davenport listed his domicile as 317 St. James Place in LaPlace, where he said he plans to move at the end of the month from a Metairie apartment where he currently lives. The LaPlace residence is in Louisiana's 2nd Congressional District; the Metarie apartment is not.

The qualifying form implies that residency in the district is required, as it is for state offices. However, federal rules do not require congressional candidates to live within the district that they wish to represent, and the 4th Circuit Court's majority said in its opinion that thestate has no authority to impose additional requirements.

Davenport was one of three candidates in the 2nd District race to see his qualifications challenged.Rufus Johnson and Gary Landrieu were both disqualified by lower courts due to outstanding ethics fines related to late campaign finance reporting.

Landrieu appealed that ruling to the 4th Circuit and succeeded in having his candidacy reinstated. Johnson did not appeal the decision.

Voting with the majority were Judge Joy Cossich Lobrano, Judge James McKay, Judge Dennis Bagneris, Judge Max Tobias, Judge Roland L. Belsome, Judge Paul Bonin, Judge Daniel Dysart, Judge Rosemary Ledet.

Dissenting were Judge Terri Love, Judge Edwin Lombard, and Judge Cabrina Jenkins.

Dick Cheney visit exposes libertarian, generational Republican divide on US military action

Washington: The young and dovish libertarians sat silently on Tuesday morning as former Vice President Dick Cheney addressed a gathering of House Republicans on Capitol Hill.

When Cheney finished his remarks on foreign policy and took questions, they eyed the door and declined to challenge him.

As he left the meeting, Representative Thomas Massie, from Kentucky, a non-interventionist, winced when asked about Cheney's counsel on how to deal with the rise of the Islamic State in parts of Iraq and Syria.

"I don't want to comment," Massie said. "He was nice enough to come over and talk to the [House Republican] conference."

Seconds later, as the questions continued, Massie, 43, sighed and offered that the "primary thrust" of Cheney's pitch was about increasing the US defense budget and that he disagreed.

"We need to spend less money on everything," Massie said.

Representative Justin Amash, Republican, 34, another non-interventionist, took a similar line as he walked out. Initially curt, he broke into a smile when he was asked whether Republicans should stop listening to Cheney.

"Yeah," he replied. "His worldview is that we should be in countries around the world and have armed forces everywhere - and most Republicans don't agree with that."

Why is the best that progressives offer the poor so second-rate?

We ask this question in light of Scott Stringers just-released housing report. The city comptroller compares owner-occupied units, market-rate rentals, rent-regulated and public housing (run by the New York City Housing Authority).

Of these, he says, public housing shows the greatest frequency of maintenance deficiencies. Rental units regulated by government come in second.

Check out the chart: The more government control, the worse the condition. Other data in the report confirm the trend more generally, with owner-occupied units typically in the best shape and public housing and rent-regulated units in the worst.

Yet Stringers answer is to dump even more money into a losing proposition: Securing funding for NYCHAmust be a priority, he says. Others claiming to champion the poor will no doubt echo this folly.

For his part, even before this report was out, Mayor de Blasio was looking to bring more apartments under government control by getting Albany to cede rent-regulation authority to the city.

Its not just housing where the needy get shafted by government. Medicaid patients often get lousy health care. And parents with kids trapped in failing public schools can tell you what thats like.

If progressives want to help the poor get ahead, why not help them get what better-off people already have private housing, private care, private schools rather than consigning them to the inferior government alternative?

APC promises to transform Nigeria in 2015

TheNational Chairman of the All Progressives Congress (APC), Chief John Oyegun, says the party will transform Nigeria if elected into power in 2015.

Oyegun spoke on Monday in Sokoto at the inauguration of the north west executive committee and a special rally.

The party wants to ensure the complete transformation of the nation when elected into power at all levels during the forthcoming polls.

This transformation will include the power sector, security, education, eradication of unemployment and poverty, among others, he added.

Oyegun commended GovernorAliyu Wamakko of the state for transforming the state in the past seven years.

Governor Aliyu Wamakko and his Kano, Imo, Edo and Zamfara colleagues, said that the partywas capable of bringing the desired change to Nigeria.

The governors also said, Nigerians want change and to maximise the God-given potentials of the country.

The APC governors and members across Nigeria are bonded by sheer vision and mission to effect change in the country, the governors added.

The Deputy National Chairman of the party, Sen. Lawal Shuaibu, said that the rally was the beginning of the crusade to bring the change Nigerians needed.

The state chairman of the party, Alhaji Bala Hassan, saidthat APC wouldemerge victorious in 2015 at all levels in the country.
