As 9/11 Pretrial Begins, ACLU Calls Out "Orwellian" Censorship of CIA Torture

On Monday, a judge will oversee pretrial hearings for Khalid Sheikh Mohammed and four other Guantanamo prisoners who are accused of plotting the 9/11 attacks. One of the key issues Army Col. James Pohl will decide on is whether or not there will be any public testimony by the prisoners regarding their torture and detention in CIA custody.

(Photo by The U.S. Army via Flickr) The defense lawyers are asking to abolish a "presumptive classification" process that treats any discussion of what happened to the defendants their time in secret CIA detention as a top national security secret. Mohammeds defense attorney, David Nevin, called the war court system a "rigged game, reports the Miami Herald. According to Nevin, attorneys and defendents "are forbidden to discuss between themselves anything from what Mohammed says the CIA did to him to his 'historical perspective on jihad.'"

The ACLU is at the hearings this week and will give a statement arguing that the censorship of torture is a constitutional challenge. In a press release, the ACLU cites the government's most recent filing (PDF):

The government has effectively claimed that it owns and controls the defendants memories, 'thoughts and experiences' of government torture. These chillingly Orwellian claims are legally untenable and morally abhorrent.

The chief war crimes prosecutor, Army Brig. Gen. Mark Martins claims that the defendants' exposure to the CIAs detention and interrogation program is classified to safeguard genuine sources and methods of intelligence gathering that can protect against future attack." In addition to the "presumptive classification," the government is pushing for a related requested of a 40-second delay in the audio feed of the commission proceedings, for censorship purposes.

The ACLU filed their motion (PDF)in May in response to the protective order and proposed audio delay:

The eyes of the world are on this Military Commission, and the public has a substantial interest in and concern about the fairness and transparency of these proceedings. This Commission should rejectand not become complicit withthe governments improper proposals to suppress the defendants personal accounts of government misconduct.

The prisoners were in the custody of the CIA for up to four years before being brought to Guantanamo in 2006. After being captured in Pakistan in 2002-2003 their detention was concealed from the International Red Cross, whose mandate is to monitor treatment of prisoners around the globe. The CIA's own declassified documents disclose that Mohammed was waterboarded 183 times in an attempt to get him to give up al Qaida's secrets.

Attacking on a section of the press, West Bengal Chief Minister Mamata Banerjee Monday alleged that some media houses wanted to control the state government and had turned against her as she did not fulfil their demands.

"Look, I cannot do everything for somebody. It is time I do some plain talking. Somebody says 'do this work for me, and if you are unable to do so, then I will bully you'. If the political leaders do not work, then you show your power. But what about your 'Dadagiri' when your interests are not fulfilled?" Banerjee asked.

Banerjee, also the Trinamool Congress chief, was speaking at an event organised by party mouthpiece "Jago Bangla".

"Some people think that they would control the government. Then do it. Fight elections. No problem... we are welcoming you," said an agitated Banerjee.

She accused some media houses of projecting only "negative" news and creating "news pollution" in their bid to malign her government.

"They do not highlight any good work. When my interest is not being fulfilled, then I am airing the negative news against the government. I do not believe in this kind of journalism," Banerjee said.

The Trinamool Congress supremo pointed out that her party left the Congress-led United Progressive Alliance (UPA) central government last month to protect the "interests of the people".

Ten veteran journalists were feted at the programme.

Aptitude, not influence, makes good social media pros

Summary: Employers should not factor in a candidate's online influence when hiring for social-related positions, but recruit those who show interest and ability to navigate the social media scene.

Employers are more interested in how candidates for social media-related positions make use of technology to advance the business, rather than evaluating each individual's suitability based on their level of social influence.

Freda Kwok, lead consultant at social media marketing agency Blugrapes, said while potential hires need to have experience using popular social networking platforms such as Facebook and Twitter, they should not be judged based on their personal use of such mediums. This means not assessing candidates based on social influence rankings provided by services such as Klout, she noted.

These scores can be easily distorted or rigged, and are not a true reflection of a person's capability to be a good online marketer, Kwok said. Furthermore, a person who has a strong online influence does not necessarily translate to having the right skillsets to manage brand campaigns and social media marketing efforts, she added.

"Employers need to assess candidates more for their professional capabilities, instead of blindsiding it based on personal abilities," she stressed.

Benjamin Koe, CEO of social media monitoring company JamiQ, similarly said the recruitment process should not take into account a candidate's personal use of social media.

"I don't agree there should be measurements at all based on social media use. It says little to nothing about a person," Koe noted.

After all, there is a big difference in having considerable social media influence personally and being able to manage social media engagement on behalf of a company, pointed out Michelle Lim, COO of jobs portal JobsCentral.

As such, she does not see prospective hires being recruited for their online presence and influence but for their ability to manage and navigate the social media scene.

Janice Tay, an online writer at a lifestyle news site, believes the practice of employers checking up on candidates' social influence scores is "more bizarre than bad". This is because such an act mixes the personal and professional use of social media, she noted.
