Democracy is government of the people, by the people and for the people, said Abraham Lincoln. That remains the simplest and most comprehensive definition of democracy. At the centre of the government are the people. Representative democracy is only a matter of convenience when the numbers are large.

India is a federal state. Delhi is the National Capital of India. It is acknowledged that the government of Delhi has to be different from the governments of states; yet, if that government must be a democratic government, it must put the people at the centre of the government.

The Supreme Court, as the final interpreter and arbiter of the Constitution, said in State (NCT of Dehi) v Union of India: (2018) 8 SCC 501: The exercise of constituent power is meant to confer democratic, societal and political powers on the citizens who reside within the National Capital Territory of Delhi that has been granted a special status. The Court quoted with approval Jaganmohan Reddy J who had said in Kesavananda Bharati that democratic form of government is part of the basic structure of the Constitution.

Constituent Power

The powers and functions of the Delhi government were finally settled by the exercise of the constituent power of Parliament. The Constitution of India was amended in 1991 and Article 239AA was inserted to provide Special provisions with respect to Delhi. The Statement of Objects and Reasons made it clear that Delhi should continue to be a Union Territory and provided with a Legislative Assembly and a Council of Ministers responsible to such Assembly with appropriate powers to deal with matters of concern to the common man.

Article 239AA used words and phrases that had acquired a meaning in every democratic country. Among them were direct election from territorial constituencies, the Legislative Assembly shall have the power to make laws with respect to any of the matters enumerated in the State List or in the Concurrent List and, most importantly, There shall be a Council of Ministers with the Chief Minister at the head to aid and advise the Lieutenant Governor in the exercise of his functions. The Government of the National Territory Act, 1991, was made under Article 239AA to give effect to the provisions contained in that Article.

The Dog and the Tail

In the last 20 years, there were instances when the tail (LG) tried to wag the dog (the council of ministers), but such attempts were put down with a firm hand. Attitudes changed after 2014. The BJP government in Delhi could not tolerate a non-BJP government in Delhi. In particular, the Prime Minister could not tolerate a Chief Minister sharing the political space in Delhi. Hence, a determined effort was made to resurrect the long-buried controversy of who exactly has the real power in the Delhi government.

The attempt was thwarted by the Supreme Court, in State (NCT of Delhi) v Union of India. On July 4, 2018, the Supreme Court declared that the meaning of aid and advise employed in Article 239AA(4) has to be construed to mean that the Lieutenant Governor of the NCT of Delhi is bound by the aid and advice of the Council of Ministers.

Mr Modi is a man of considerable ego (as I suspect all prime ministers are) and does not give up his pursuit of wrong goals. He bided his time and chose to strike when the country was focused on crucial elections in four states and one Union Territory. He could not touch Article 239AA because the NDA does not have a two-thirds majority in both Houses of Parliament; so, he chose the lesser option of amending the Government of the National Capital Territory Act, 1991. Mocking the Supreme Court, the Statement of Objects and Reasons said that the amendment Bill was brought forward in order to give effect to the interpretation made by the Honble Supreme Court! In truth, the Bill is a clumsy attempt to overrule the judgement of the Supreme Court.

Patently Unconstitutional

The Bill amends the law by stipulating that the expression Government shall mean the Lieutenant Governor. Thus, by definition, the tail is the dog and the dog is the tail! The Bill also provides that before taking any executive action to exercise powers of Government the opinion of the Lieutenant Governor shall be obtained on all such matters as may be specified. By legislative legerdemain, the Modi government has installed its Viceroy in Delhi!

Mr Arvind Kejriwal and his ministers have been reduced to footmen to fetch and carry for the Viceroy.

Mr Kejriwal should have known that this day was coming when, in another constitutional coup, Jammu & Kashmir was dismembered and reduced to two Union Territories. Yet, Mr Kejriwal supported that assault on democracy in the name of nationalism. Today, it is his day of reckoning and humiliation. Nevertheless, my sympathies are with him if he chooses to fight the Modi government.

Democracy in India is diminished every day. The world has taken note of the fact that India is only partly free. The goal of the BJP is to establish one-party rule, an over-sized and rubber-stamping Parliament, a compliant judiciary, an officially sponsored media, obedient corporates, and a subservient people who will be happy with material progress. That India will be no different from China. It is deja vu 1935, the Government of India Act, 1935, and Go Back Simon.

A shipping vessel that could clog the Suez Canal for weeks is the latest piece added to an ever-evolving conspiracy theory about former Secretary of State Hillary Clinton and other members of a so-called deep state and links to human trafficking.

Communications channels where QAnon conspiracy theoriesspread were humming this week about a connection between Clinton and the quarter-mile-long ship that ran aground as high winds cut across the canal.

Those seeped into mainstream social media as well, including posts on Facebook and Instagram, where users tied Clintons Secret Service codename to the ship and suggested its radio call sign intentionally matched Clintons initials.

A Facebook user who shared the post did not respond to a request for comment. It speculates without evidence that Evergreen "is most likely a cover for human and sex trafficking."

Others pushing the same theory allude to the containers being opened on television to reveal trafficked people inside. It is the latest potential disclosure related to the QAnon conspiracy theory that says former President Donald Trump was elected to thwart a deep-state cabal of pedophiles and cannibals, including Clinton.

At about a quarter-mile long, the ship was built in 2018 as one of the largest in the world, according to the Associated Press. It first got lodged in the canal at about 7:45 a.m. March 23, halting traffic in a key shipping channel between the Mediterranean and Red seas.

The conspiracy theory goes like this: The ship that is stuck in the canal, the Ever Given, is owned by Taiwan-based Evergreen Marine and carries the radio call sign H3RC. Clintons Secret Service code name is Evergreen, and her initials are HRC.

Those pushing the theory connect the ship to human trafficking but provide no evidence. Evergreen did not respond to a request for comment.

CNN reported in 2016 that Clinton, then the Democratic nominee for president, was keeping the code name assigned to her when she was first lady. Code names for the presidents family generally start with the same letter as the presidents moniker. For example, President Bill Clintons code name was Eagle and Hillary Clintons was Evergreen.

Evergreen Marine was established in 1968, according to its website, when Clinton was still in college.

Ever Givens call sign is indeed H3RC, according to MyShipTracking.com. But the initials are a coincidence as well.

The International Telecommunications Union in Geneva, Switzerland, regulates call signs. The union is a specialized agency of the United Nations.

The first two characters of a maritime call sign constitute the nationality identification for the ship, according to the 2020 edition of the agencys radio regulations. The H3 characters are assigned by the union to Panama, under whose flag the Ever Given sails, according to those regulations.

QAnon believers have targeted Clinton as part of several conspiracy theories.

In one, a decoded email allegedly implicated her and former President Barack Obama in child sex-trafficking. Another from 2018 claims there is video of Clinton and her former aide Huma Abedin sexually assaulting a young girl, according to FactCheck.org.

Earlier this month, a website wrote that Navy Seals acting on Trumps order had arrested Clinton, even though Clinton made several public appearances after the alleged arrest.

Perhaps the most famous of theconspiracy theory involving Clinton is Pizzagate, a 2016 presidential election falsehood that claimed Wikileaks had released emails showing Democrats linked to Clinton were running a child-sex ring in the basement of a pizza shop in Washington. A North Carolina man was arrested after firing a rifle into the restaurant.

None of those conspiracy theories is true. Clinton responded to falsehoods spread about her during an interview with The New York Times in February.

For me, it does go back to my earliest days in national politics, when it became clear to me that there was a bit of a market in trafficking in the most outlandish accusations and wild stories concerning me, my family, people that we knew, people close to us, Clinton told the Times.

The claim that a ship stuck in the Suez Canal is a human trafficking vessel with links to Hillary Clinton is FALSE. Those pushing the conspiracy theory offer no proof that the ship is transporting people to be trafficked. The theory is another in a long line of falsehoods spread online about Clinton and human trafficking.

As attempts to refloat the wedged cargo ship in the Suez Canal continue, the unusual event has been sparking a lot of global conversations just as much as conspiracy theories.

On Telegram, an account associated with the US-based QAnon conspiracy theory has linked the Ever Given incident with the former US candidate for presidency Hillary Clinton.

According to this theory, the Japanese-owned Ever Given was "deliberately" stuck at the EgyptianSuez Canal "as a cover for a human trafficking activity."

Despite experts statements linking the incident to the fact thatthe ship, which is one of the largest in the world, was impacted by strong desert wind last week, causing it to block traffic across the vital waterway, believers in the QAnon theory havesuggested that "the ship is actually being used by a sex trafficking ring owned by Hillary Clinton, aimed to smugglechildren."

However, the message that has gone viral across the internet has provided very little proof of this claim, other than saying that the name of the company that owns the ship "is the same code name Clinton used during the 1990s."

For years now, individuals who believe inthe QAnon theory have linked several international events andAmerican politicians and celebrities who have been strongly criticized by the former US President Donald Trump to human trafficking rings.

In March 2021, a massive cargo ship called the Ever Given got stuck in the Suez Canal, blocking one of the worlds busiest shipping routes. As authorities began working on a way to dislodge the stuck ship, conspiracy theorists went to work spreading unfounded rumors claiming that the ship was being used by former U.S. Secretary of State Hillary Clinton in a child-trafficking scheme.

The claim that Clinton is trafficking children via the stuck cargo ship is based on a pair of seemingly odd coincidences.

First, the company that owns this ship is Evergreen Marine Corporation. According to journalist Ronald Kesslers book In the Presidents Secret Service: Behind the Scenes with Agents in the Line of Fire and the Presidents They Protect, Evergreen was the name the Secret Service once used for Clinton.

Second, the call sign for this boat is H3RC, which, with a little fudging, appear to be Hillary Rodham Clintons initials.

Why Clinton would leave behind clues to implicate herself in this alleged crime has not been explained. Furthermore, if there were any truth to these claims, one would expect a massive police presence at the Suez Canal as children are removed from these ships, as well as the announcement of an investigation into Clinton. None of that has come to pass, however, as this is nothing more than a perceived coincidence.

Conspiracy theories are often built by people in search of dots to connect. In this case, some social media users noticed that this international incident bore some superficial coincidences to Clinton who has been the target of a variety of baseless QAnon and Pizzagate conspiracy theories concerning the occult and child trafficking since her run for president in 2016 and concluded that the only explanation was that Clinton was trafficking children through the Suez Canal via cargo ship. With the same barrier of evidence (taking two random factoids and forcibly drawing a line to connect them), one could argue that since this ships International Maritime Organization (IMO) number is the same as a dentists office in Jacksonville, Mississippi (minus the area code), this cargo ship was clearly carrying thousands of pounds of dentures.

The conclusion that this ship was trafficking children (and that Clinton was somehow involved) was reached despite the fact that no children have been seen in the containers aboard this ship, no records have been unearthed that would connect Clinton to this company, or that the Evergreen Marine Corporation has been in operation since the 1960s, long before Clinton first warranted Secret Service protection. It should also be noted that anti-trafficking organizations such as the National Center for Missing and Exploited Children, the Coalition to Abolish Slavery and Trafficking, and The Polaris Project, have made no statements suggesting that this cargo ship could be carrying trafficked children.

In July 2020, a similarly baseless rumor was circulated that claimed the furniture store Wayfair was involved in child trafficking. This rumor was based almost entirely on the perception that some of Wayfairs cabinets seemed overpriced. Polaris, the organization that runs the U.S. National Human Trafficking Hotline, released a statement at the time saying that its phone lines had been clogged by conspiracy theorists, which had made it difficult for the Trafficking Hotline to provide support and attention to others who are in need of help.

In a LinkedIn post, the company said: "Earlier this year, Invisible Hand joined Archewell on their mission to drive systemic culture change across all communities, one act of compassion at a time."

Genevieve Roth was previously the director of Creative Engagement for Hillary Clinton's 2016 presidency campaign.

After graduating from Emerson College and the Columbia Journalism School Publishing Course, Ms Roth also worked with a US government initiative launched by former President Barack Obama and wife Michelle: Let Girls Learn.

And the link adds fuel to speculation that Meghan is keen to get into politics after the 39-year-old former actress and Harry, 36, quit the Royal Family.
