Barents Observer takes case against Russian censorship to European Court of Human Rights – The Independent Barents Observer

Independent cross-border journalism isnt a crime, it builds on core democratic rights for freedom of the media, says Thomas Nilsen.

Theeditor in February 2019 saw his independent online newspaperbeing blocked in Russia following a crack-down by Roskomnadzor, the Russian media regulating authority. It was a major blow to the small northernmedia that since its launch in 2002 haspublished in both English and Russian.

The blocking followed the publishing of an article about Dan Eriksson an indigenous Smi man who managed to accept his homosexual orientation and overcome psychological crisis. Roskomnazor argues that the story propagates suicide.

The repressive decision was in July 2019 appealed in court. After a loss, a new appeal was filed and subsequently rejected by the Moscow City Court in January 2020. In June 2021, the case was ultimately rejected by the Russian Supreme Court.

The case Barents Observer vs Roskomnadzor has been supported by Memorial, the Anti-Discrimination Center based in the Netherlands. It is lawyer Maksim Olenichev that isfollowingup the case.

The Barents Observer vs Roskomnadzor is now taken to the European Court of Human Rights (ECHR).

After all opportunities to achieve justice in Russia were exhausted, in August 2021, the complaint to the European Court of Human Rights was filed, ADC Memorial says in a statement.

The case is applied on the violation of Article 10 of the European Convention (freedom of the media, expression, dissemination of information) and Article 13 in conjunction with Article 10 (the right to an effective remedy).

According to ADC Memorial, the accusationsabout propaganda of suicide in the disputed article about Dan Eriksson are completely absurd.

Dan Eriksson is an activist of the organization Suicide zero, he helps other people to overcome suicidal tendencies of suicide and find the will to live.

The case against the Barents Observer directly relates to the current press freedom situation in Russia, the Center argues.

The case of the Barents Observer shows many aspects of the problem of discrimination including violations of the rights of indigenous peoples, persecution of LGBTI+, restriction of the right to freedom of speech. The opportunity to freely publish serious materials on socially sensitive issues is especially important today, when censorship de facto is applied in the Russian media sphere, and many independent journalists are expelled from their profession due to the repressive legislation on foreign agents. At the same time, the state bodiesdo not respondproperly to the open expression of xenophobia and racism in the media space and provoke hate crimes in real life, the ADC Memorial writes.

The Barents Observer is a journalist-owned newspaper that comprehensively covers development in Russian society, politics and economy. It is based in the Norwegian border town of Kirkenes, close to the Russian Kola Peninsula.

Stamping out critical voices like NGOs, opposition politicians or activists isnt an alternative for us in the Barents Observer. Instead we fight Russian authorities censorship in court, Nilsen says.

Russian opposition candidates rallied in Moscow against a law that labels certain media organizations foreign agents.

Critics see the label as a form of pressure on free media ahead of the upcoming elections.

Russia blocked access to six virtual private networks, including some of the worlds most popular such services, as the government escalates its efforts to rein in the internet.

NordVPN and Express VPN were among the networks blocked for allowing access to prohibited information and resources, communications watchdog Roskomnadzor said in a statement Friday. These include material Russian authorities have deemed as extremist as well as what the regulator said was information relating to narcotics and child pornography.

Russia has ramped up its attempts to control access to information in the run-up to parliamentary elections this month, deeming numerous independent media groups as foreign agents subject to punitive restrictions and regularly fining international platforms including Alphabet Inc.s Google and Facebook Inc. for failing to remove content flagged as illegal.

VPNs help circumvent restrictions on internet traffic and provide users with anonymity and greater security. Roskomnadzor said it has created a white list for software and apps that use VPNs for technical reasons that will be allowed to continue.

Russia already has a long list of websites, messaging apps, and other digital services that are blacklisted, as well as a series of laws that threaten the prosecution of bloggers and allow authorities to ban websites without a court order, NordVPN said in an e-mailed statement. Plans to block VPNs are just another move to strengthen governmental control over online communications.

NordVPN destroyed its servers in Russia after the government sought access in 2019 and will continue to offer its products through available channels, the statement said. Express VPN did not respond immediately to a request for comment.

The move comes amid an increasingly harsh crackdown on opposition that began with the arrest of President Vladimir Putins most vocal critic, Alexey Navalny, early this year. Since Navalnys detention, groups affiliated with him have been labeled extremist and most of his top aides have fled the country amid the threat of criminal prosecution.

Pressure on foreign technology companies has also increased. Twitter Inc. was hit with measures that made it slow to load for failing to delete content. Roskomnadzor warned Google and Apple Inc. they may be regarded as interfering with the election process if they dont remove an app started by Navalny, state-owned Tass reported this week, citing the watchdog.

Russias technical capabilities have improved since it sought to block the Telegram messaging platform several years ago over failure to share encryption information. It was unable to enforce the ban and ultimately backed down. But following a 2019 law, authorities have upgraded systems they say would allow Russia to completely cut itself off from the internet.

Morgan Stanley: Apple Car focus is on design and the vehicle – Fox Business

Morgan Stanley analyst Katy Huberty shared her thoughts recently about how tech giant Apple might approach the development of the rumored Apple Car.

Apple has been working on projects related to car development since at least 2014. Rumors and reports have been inconsistent. At one point, reports indicated that Apple had decided to focus on vehicle software. But now it appears that Apple is focused not only on software but also a car for consumers.

Adam Jonas, also an analyst at the investment firm, talked with Huberty about the Apple car project in an interview published by Morgan Stanley,

"The car is essentially the next mobile device, and this is a category that Apple has focused on for years," Huberty said, adding that Apple tends to focus on markets where "computing will become central to a humans everyday life."

Apple does software and hardware

One of the most common questions is, "Why doesnt Apple just focus on software and services?" Huberty said. After all, making the hardware and software right out of the gate as Tesla has done is fraught with complexity. And for a new car company, getting it right isnt always possible.

"Apple takes the other side of that. The strategy is about doing fewer things, but doing them really well, and increasing the chances of success," she said.

"Apple is successful when they're vertically integrated. They want a hand in the design, in how the software communicates with the hardware, what are the right components and technologies to use," Huberty said.

"So, they cant be successful in services until theyre successful in selling the device that this new type of computer and services sit on top of," she said.

That means it is probable that Apple will come out with an electric vehicle.

"I wouldn't be surprised if Apple comes to market with an EVThey did this with the iPhone, where in the first iPhone, there was no app store. It was first about getting the hardware right," Huberty said.

"I think the focus right now, Im sure, is on design and the vehicle itself, but with well thought out plans around what services could emerge longer term," she said.

As Tesla has shown, development of an autonomous or "self-driving" vehicle is a major focus. For example, Teslas FSD (Full Self Driving) option on vehicles like the Model Y adds $10,000 to the cost of the car but provides hands-free driving in many scenarios using Teslas AI software.

"The right question is, How big is the auto market and can Tesla help transform all of the auto market into EVs, and eventually AVs [autonomous vehicles]?" Huberty said.

Apple CEO Tim Cook has said that Apple is focusing on autonomous systems for self-driving cars as part of thecar project.

"We sorta see it as the mother of all AI projects. It's probably one of the most difficult AI projects," Cook said in 2017.

GitHub merges ‘useless garbage’ says Linus Torvalds as new NTFS support added to Linux kernel 5.15 – The Register

Linus Torvalds will pull Paragon Software's NTFS driver into the 5.15 kernel source but he complained about the use of a GitHub merge in the submission, saying that GitHub "creates absolutely useless garbage merges."

Early last month Torvalds gave Paragon Software a nudge that it really should submit a pull request an actual submission of code to be merged into the kernel source in order for its read-write NTFS driver to be included in the forthcoming 5.15 release, for which the merge window is currently open. NTFS is the native Windows file system and Paragon's implementation will improve interoperability, versus the existing driver which has limited write support.

On Friday Paragon duly submitted its pull request, saying: "Current version works with normal/compressed/sparse files and supports acl, NTFS journal replaying."

However, the company is still getting to grips with the submission process and Torvalds had several comments to make, intended to improve future pull requests.

First, he said the pull request should have been signed. "In a perfect world, it would be a PGP signature that I can trace directly to you through the chain of trust, but I've never actually required that," he said.

Second, he noted that the code in the pull request included merge commits done with the GitHub web user interface. "That's another of those things that I *really* don't want to see github creates absolutely useless garbage merges, and you should never ever use the github interfaces to merge anything," he said.

He added: "[G]ithub is a perfectly fine hosting site, and it does a number of other things well too, but merges is not one of those things."

Torvalds has complained about aspects of GitHub before, saying in 2012: "I don't do github pull requests. github throws away all the relevant information, like having even a valid email address for the person asking me to pull. The diffstat is also deficient and useless."

Note that the git request-pull command is different from the GitHub pull request feature. The ensuing forthright thread has more information on the subject.

Third, Paragon's repository has commit messages which lack information, like "Merge branch 'torvalds:master' into master."

Torvalds said that "Linux kernel merges need to be done *properly*." He added: "That means proper commit messages with information about what is being merged and *why* you merge something. But it also means proper authorship and committer information etc. All of which github entirely screws up."

Don't do this: A merge using the GitHub user interface

The pull request was nevertheless merged. "The initial pull often has a few oddities and I'll accept them now, but for continued development you need to do things properly," said Torvalds.

An example of a well-commented change came from Torvalds yesterday, when he amended the Makefile used for compiling the kernel to "enable '-Werror' by default for all kernel builds but make it a config option so that broken environments can disable it when required."

The meaning of -Werror is "Make all warnings into errors," requiring stricter discipline for code that would otherwise compile but with warnings about suboptimal code.

Torvalds added that "we will disable specific over-eager warnings as required, if we can't fix them."

"Hopefully this will mean that I get fewer pull requests that have new warnings that were not noticed by various automation we have in place Knock wood," he said.
