Holder Admits He Regrets Labeling Foxs Rosen a Co-Conspirator

Before Washington Post columnist Jonathan Capehart ended his interview with Attorney General Eric Holder at the Washington Ideas Forum Wednesday, he asked one final question: Whats the one decision you made that you wish you could do over again?

Without much hesitation, Holder brought up the Justice Department subpoena of Fox News reporter James Rosen, who had his communications tracked in 2009 after he was suspected of receiving secret information from government sources on North Korea. In a subpoena to Google to obtain Rosens emails, the government labeled him as an aider and abettor and/or co-conspirator.

Holder said he could have been more careful in the language that was used in the court filing, especially regarding the word co-conspirator. While he said the department had to do that as a result of the statute, he added that there are ways in which I think that could have been done differently, done better.

The attorney general indicated that he felt the criticism he received for those actions was fair and said that it sparked a review of the way the Justice Department interacts with the media.

Rosen has not yet responded to Holders comments directly, but he did retweet several mentions of them on his Twitter account Wednesday:

Napolitano on Eric Holder's job

Former Homeland Security Secretary Janet Napolitano considered a long-shot candidate to replace Eric Holder as attorney general stressed Monday that she plans to stay in her current job for a long time but didnt rule out returning to Washington.

When asked Monday whether she was interested in being Holders successor at the Justice Department, Napolitano chuckled.

Let me put it this way, Napolitano, the current president of the University of California, said in a phone interview. I think Ive got one of the best jobs in public service, and I intend to hold it for a long time.

She added: I dont speculate on things that I havent been offered. Napolitano also declined to say whether she has been contacted by administration officials on replacing Holder.

Holder announced late last month that he will step down after six years as the nations top law enforcement official. He plans to stay on until his successor is confirmed, although its unclear when that will occur. The White House says it wont announce a nominee until after the midterm elections.

Much of the speculation had centered on three candidates: former White House counsel Kathryn Ruemmler, Labor Secretary Tom Perez and Solicitor General Don Verrilli. But Ruemmler last week told the White House that she wanted to be withdrawn from consideration.

Napolitano spoke to POLITICO ahead of her speech Monday afternoon at the University of Georgia School of Law, where she planned to detail the internal deliberations around the time the administration announced and implemented the Deferred Action for Childhood Arrivals program the 2012 initiative that shielded hundreds of thousands of young undocumented immigrants from deportations.

Speaking to a gathering of police chiefs Monday, Attorney General Eric Holder said that the work of law enforcement is often thankless and challenging, but is absolutely vital to the U.S. and to the world.

These sacrifices are too often overlooked, Mr. Holder told the annual conference of the International Association of Chiefs of Police. And I believe we do ourselves, our communities and our nation a grave disservice if we ignore these difficulties.

Law enforcement officials, who the IACP represents, provide leadership in their communities, but must continue to address ongoing tensions like those in Ferguson, Missouri, the attorney general told the groups annual gathering in Orlando.

As law enforcement leaders, it is incumbent upon each of us to take constructive, inclusive steps to rebuild trust and instill respect for the rule of law in all of the communities where these tensions are uncovered, he said. When people have faith in the integrity of the process they are more likely to cooperate with local authorities and obey the law, even if they disagree with particular outcome.

Mr. Holder also addressed the growing topic of heroin overdoses, advocating for all police officers to be equipped with anti-overdose medication, such as the compound naloxone.

I am confident that these efforts will save and improve lives while conserving precious resources, Mr. Holder said. We must never and we will never stop being vigilant against crime, or the conditions and choices that breed it. But investing in effective prevention, treatment, and rehabilitation; ensuring that incarceration is used appropriately and reserving the toughest penalties for serious, violent, or high-level traffickers can only serve to strengthen our criminal justice system as a whole.
