When arresting employers of illegal immigrants actually works – Hot Air

I realize were in the midst of numerous discussions involving construction of the border wall and hiring new immigration law enforcement officers, but there remains a far more effective tool in combating illegal immigration available to us. I wanted to draw your attention to a story in the Los Angeles times this week which deals with an immigration raid taking place a decade ago at a French restaurant in that city. This is a remarkable story to see cropping up in a large, generally liberal newspaper because it offers the refreshing perspective of a business owner who was once busted for employing illegals but now wants enforcement to be more strict.

Michael Malecot is the owner of The French Gourmet, an upscale restaurant in Pacific Beach. In 2008 he was the subject of an ICE raid which netted several aliens working illegally at his eatery. Unlike far too many of these raids, it wasnt just the busboys and dishwashers who wound up getting in trouble with the law. Malecot himself was charged in the case and wound up being convicted and paying a rather stiff fine which he claims nearly put him out of business. Today the owner is a regular user of the E-Verify system and claims that he is in 100% compliance with the law in all of his hiring practices. Unfortunately, he goes on to say that this puts him at a disadvantage because the government does not enforce this law with an even hand and many of his competitors are still getting away with hiring cheap, illegal labor and not paying any price for it.

It was a difficult time, Malcot, 65, recalled in an interview in his cozy 45-seat dining room last week. He feared at one point he would lose his business. I am very lucky to love what I do.

A misdemeanor conviction and $396,000 in court-ordered payments later, Malcot says he is now 100% compliant when it comes to hiring legal workers through use of E-Verify, the government web-based program that green-lights the eligibility of employees.

But because the program is voluntary, many restaurants dont use it and whether knowingly or unknowingly employ unauthorized immigrants. Malcot said that puts him and other employers following the law at a disadvantage when their competitors have a larger workforce to pull from and the potential to pay lower wages.

One item which stands out in the story is the result of the court case against Malecot. Yes, he wound up paying more than a quarter million dollars in fines, fees and court costs, but he was convicted of a misdemeanor. How does that work? There are federal laws against aiding and abetting people who are in the country illegally so this mustve been some sort of a plea deal. The raid worked out well in the case of this one restaurant and the stiff fines might have sent something of a message to other employers in the area, but as Malecot himself notes, the memo clearly didnt get to everyone.

Ive been up on this particular soapbox in the past and the underlying point of the story remains just as true now as it has ever been. I firmly believe that the quickest and most efficacious method of cutting down on illegal immigration is to remove the main incentive for people to cross the border in violation of the law and choose to remain here. That means jobs. If the supply of employment and income essentially disappears you will see illegal immigration fall off virtually overnight to a degree which no amount of strict law enforcement activity will ever accomplish. Thats not to say that we shouldnt be building a wall, hiring more ICE officers, border patrol and all the rest. We absolutely should. But their jobs will become much easier with a smaller number of targets to go after, many of whom will likely wind up being gang members and those working outside the normal capitalist system.

E-Verify is out there and ready for use. Every owner of a business either knows about it or darn well should know about. The problem is we are still too reticent in prosecuting the people who would actually matter. Handing down a big fine to one restaurant owner is nice but its simply not enough. As I have said before, the first time that you see the millionaire owner of a huge restaurant chain or the CEO of a national retailer standing in an orange jumpsuit and leg irons in front of a judge who is handing down a 10 year sentence, jobs for illegal immigrants will evaporate in the blink of an eye. It may not be politically popular and could turn off some potential donors, but its a solution which is available and sitting out there on the table right now.

Illegal immigrant with lengthy rap sheet charged in deadly California car accident – Fox News

An illegal immigrant, who has been deported five times, caused a collision in Southern California last month that left one woman dead, police said.

Estuardo Alvarado, 45, allegedly slammed into the the back of Sandra Duran's car on Feb. 19 in North Hills, the LA Daily News reported Monday.

Alvarado was driving a 1999 Dodge Durango on a rain-stricken busy road when he attempted to pass other cars at a high rate of speed when he hit a parked car at a curb, police say. He struck Durans Toyota Camry while trying to flee the scene of the initial crash, police said.

Duran died at the scene of blunt force trauma, a medical examiner said.

Federal authorities told the newspaper that Alvarado is an illegal immigrant with a lengthy rap sheet that includes the deportations.

The 45-year-old Lakeview Terrace man was charged with five felony counts in connection to the accident, including murder and gross vehicular manslaughter while intoxicated, the Los Angeles County District Attorneys office said. Alvarado pleaded not guilty to all charges.

Alvarado had been on Immigration and Customs Enforcement's radar since 1998, when he was first deported, the LA Daily News reported.

Since 1990, Alvarado has been charged with more than 20 felonies and misdemeanors, according to the paper. Some of the cases reportedly include being a felon in possession of a weapon and the sale or transport of a controlled substance.

He had been convicted or pleaded guilty to several charges, including driving under the influence and misdemeanor hit-and-run, while others had been dismissed or not prosecuted for unknown reasons.

ICE is now planning to take action against Alvarado.

U.S. Immigration and Customs Enforcement (ICE) has lodged a detainer against Mr. Alvarado seeking to take him into custody if and when he is released by local authorities in order to pursue follow-up enforcement action, authorities told the newspaper.

Alvarado is being held at the Mens Central Jail on $2.18 million bail, according to Los Angeles County Sheriffs Department records. His next hearing is set for March 14.

Oliver Mauricio Funes-Machada, 18, has been confirmed to Breitbart Texas by the Immigration and Customs Enforcement (ICE) agency as an illegal immigrant living in North Carolina from Honduras.

ICE Enforcement and Removal Operations (ERO) has issued a detainer for Oliver Funes-Machado, an unlawfully present Honduran national, following his arrest March 6 on local charges in Franklin County, North Carolina, ICE Communications Director Bryan Cox told Breitbart Texas.

Funes-Machada allegedly killed 35-year-old Yesenia Funes Beatriz Machada by severing her head, and then allegedly carrying her head in his hands, along with a butcher knife, down the street, according to the Charlotte Observer.

When they arrived, he was with the decapitation in his hand and it was a gruesome scene, Sheriff Kent Winstead told the media at the time.

It was a gruesome scene I cant tell you how many wounds, Winstead said.

Funes-Machada is allegedly the oldest sibling of his family, with two minor children at the home at the time of the alleged beheading, though authorities said they were unharmed. Another sibling was at school at the time of the alleged attack.

Funes-Machada is currently being held at the Franklin County Detention Center without bond, and ICEs Bryan Cox said the agency has requested that the illegal immigrant be turned over to federal authorities, should he be released for any reason.

Obamacare 2.0 Guts Enforcement, Gives Illegal Aliens Health Care Through Identity Fraud – Breitbart News

A draft of the bill, released by the House Committee on Ways and Means, cannot even include bare-bonesprovisions requiring officials to check an enrollees immigrationstatus, the Conservative Reviews Daniel Horowitz warns, calling it a gift to illegal aliens.

Obamacare included provisions from an earlier bill allowing illegal aliens with fraudulent documents to apply while the government and Obamacare managers looked the other way. Eager for welfare state clients and looking to grease the skids for a massive amnesty down the road, Obamacare navigatorssigned up thousands of illegal aliens for benefits.

President Obama had already paved the path for illegal alien Obamacare when he signed the massive expansion of the State Childrens Health Insurance Program (S-CHIP) in 2009, conservative author Michelle Malkin explained in March 2014. As Ive reported previously, the law loosened eligibility requirements for legal immigrants and their children by watering down document and evidentiary standardsmaking it easy for individuals to use fake Social Security cards to apply for benefits with little to no chance of getting caught. In addition, Obamas S-CHIP expansion revoked Medicaid application time limits that were part of the 1996 welfare reform law.

Obamacare has no meaningful, robust protections in place against illegal aliens claiming health care. The law claimed to exclude illegals, but in practice, made no effort to verify that the people applying for health care were citizens. Now, Republicans are about to take that problem and make it much worse by gutting enforcement, Horowitz says:

Although Obamacare didnt require photo ID and fingerprints to verify identity, it did harness the Department of Homeland Securitys Systematic Alien Verification for Entitlements (SAVE) database. Thus, officials were at least able to check immigration status against Social Security numbers.

The problem with this bill is that because it tweaks Obamacare and creates a new massive entitlement system through the budget reconciliation process, it cannot have the statutory effect of mandating HHS and IRS work with Citizenship and Immigration Services to use the SAVE database because that issue is outside the jurisdiction of the reporting committees. And no subject matter from other committees can be included in reconciliation.

Thus, to pass Obamacare 2.0 instead of plain repeal via budget reconciliation, Republicans must use weaker verification language.

Allowing illegals access to health care through fraud is a disastrous move, Horowitz shows. What Republicans are doing is almost inexplicable: Ramping up the most punishing aspects of Obamacare while removingeven its fig-leaf requirements against granting illegal aliens health care. Except, according to Horowitz, they never intended to repeal the meat and potatoes of Obamacare at all.

Theres also the deeply troubling aspectof Republicans encouraging illegal immigration with enticing incentives and promisesnot to punish law-breakers.Illegal alien identity theft is a serious, widespread problem. Since its all but impossible to work and collect benefits in the U.S. without valid ID and documentation, illegals commit felonies to steal Americans Social Security numbers and forge tax documents.

The demand is so great for counterfeit documents because the illegal alien population wants to workthats the majority of their motivation for wanting to cometo this country, one former immigration officer told Fox News in December. So theres a huge demand for those documents that are required to pass the employment eligibility verification procedures. In every neighborhood where theres a significant illegal alien population, there are at least several document vendors who supply this service, he said. Illegals typically buy three fraudulent documents: A counterfeit resident alien card or work authorization card, plus a counterfeit California drivers license, and a counterfeit Social Security card, which costs about $120 to $300. He encountered at least one hundred illegals during his career with voter registration cards who admitted they had voted in a U.S. election.

With well over ten million illegals in the U.S. and so many buying up fake documents, there will almost certainly be a massive rush to claim health care benefits, especially with liberals looking to sign up illegals to resist against the Trump administration.

If nothing is done, Obamacare 2.0 will contain the same verification provisions as the original version that have enabled illegal aliens engaging in identity fraud to access the subsidies, Horowitz writes.

Its an insult to injury for Americans victimized by mass immigration policies and punishing healthcare regulations. Yet some Republicans seem eager to inflict more pain on the very voters who put them in power.Poll after poll shows Trumps immigration policies prioritizing Americans, particularly struggling and vulnerable citizens, over foreigners are hugelypopular with voters. Republicans in Congressignore these votersand their pleas for affordable health care and immigration enforcement at their own peril.

When illegals overrun US national parks – Washington Times

ANALYSIS/OPINION:

Every year, hundreds of thousands of illegal border-crossers pass through our national parks and wildlife refuges on their way to the interior to secure unlawful work or to smuggle in people and drugs. The trash, waste and discarded vehicles brought in by these thousands of individuals is so large federal land management agencies have admitted it has altered the ecological processes and degraded habitats in these areas. Newly confirmed Secretary for the Interior Ryan Zinke has a chance to change this and make great again our nations worst effected parklands.

Federal statutes like the Wilderness Act of 1964 were enacted to ensure that our nations most prized national endowments would be off-limits to exploitation and made fully available to the American public. But as the Interior Departments National Park Service told the Immigration Reform Law Institute (IRLI), in some of our natural reserves today, like southern Arizonas Organ Pipe Cactus National Monument, nearly half of all trails and sites are completely closed to the public due to high levels of illegal immigration and smuggling activities. In the closed-off areas, even park service staff must be accompanied by their agencys own special law enforcement, itself a recent development in direct response to the level of dangerous illegal alien activity. Internal agency reports show thousands of pounds of drugs being seized in our parks annually sometimes trafficked in with cloned agency trucks. And according to the Justice Department, this is all due to the regions largely unprotected border.

On top of being kept out of their own national parks, the American public is also being kept out of the conversation. Both the National Park Service and its sister component, U.S. Fish and Wildlife, have explained to the IRLI they dont even estimate the damages to the natural and cultural resources that result from illegal border-crossing. How much is attributed to illegal aliens and smugglers in terms of theft, violent crime and diversion fires, which are purposely set to shake off border agents, the agencies cannot tell us.

As a result, the public is relegated to one-off Government Accountability Office reports or the very rare congressional hearing to find out whats happening in their national parks. But by not assessing the damages and dangers in our parks, the public is kept in the dark and our elected officials will never address the issue. In contrast, President Trump has recently mandated that the Homeland Security Department track and report illegal-alien crime. By doing so, the president is making the consequences of immigration fully transparent for the American people. Mr. Zinke must do the same.

On top of transparency, the secretary can make direct changes. Section 7 of the Endangered Species Act states that Cabinet secretaries must ensure their federal actions do not jeopardize the existence and habitats of endangered or threatened species. Not only must those agency heads consult with the secretary for the interior, but the secretary may himself initiate those consultations. Following these consultations, if the secretary finds plant and animal species are being threatened, he must suggest alternative solutions.

Documents the IRLI received already show Mr. Zinkes agency has made these findings visvis illegal border-crossing and that the agency wants change. According to internal reports from U.S. Fish and Wildlife about its Cabeza Prieta National Wildlife Refuge, the foot and car traffic caused by illegal aliens (as well as Border Patrol agents) has impacted vegetation, hydrological processes, wilderness character and animal life, including the much-endangered Sonoran pronghorn. Considering so much of our immigration system, including federal actions, encourages or allows hundreds of thousands of illegal border-crossers to stream through our border-area parks and refuges annually, Mr. Zinke must call on our immigration agencies to turn off the main magnets of illegal immigration (employment, welfare, birthright citizenship) and ensure that we have the strongest fence possible to keep out the cartels.

The Wilderness Act recognizes our most precious natural possessions as areas where the earth and its community of life are untrammeled by man, where man himself is a visitor who does not remain. Thats a promise to our progeny which we must keep.
