On 10/3/2014, The State of New York Department of State Committee on Open Government issued a four page advisory opinion. The Committee's opinion goes against Governor Cuomo's refusal to release NYSAFE Act information requested in FOIL filings

Albany, NY The Committee on Open Government dealt a significant blow to Governor Cuomo and the New York State Police through their October 3, 2014 Advisory Opinion that there is no legal basis for the refusal to release aggregate statistical information about the assault weapon registry. This on the same day that three, powerful supporters of the Second Amendment served the Governor and the NYS Police with Petitions to demand production of information in response to earlier demands made pursuant to the Freedom of Information Act during the past eight months. The groups filing suit are Gun Owners of America, the Shooters Committee for Political Education (SCOPE), and Bill Robinson (host of the syndicated Second Amendment Radio Show).

The Committee's Advisory Opinion follows eight months of work by these groups to get responses to this and other requests related to the 2013 SAFE Act. Although as a matter of procedure, it is generally the state agency that sends copies of the agency appeal papers to the Committee, the groups submitted its own copies to make sure that the Committee was informed of the difficulties they were experiencing.

The 4-page Advisory Opinion by the Committee could not be more clear: it is our opinion that disclosure of aggregate data or that which can be derived from the collected records and reported without identification of individual licensees is subject to disclosure under the Freedom of Information Law.

We are thrilled with the Opinion of the Committee on Open Government, said Bill Robinson, whose weekly radio show is heard across New York from WYSL AM1040. The work of the independent Committee on Open Government is particularly vital in a state like New York where the Governor says transparency' but then hides from basic questions.

Larry Pratt, Executive Director of the national organization Gun Owners of America pointed out, Connecticut and Colorado released their registration information promptly upon deadline. It has been amazing to think that a state like New York has forced us to undertake so much legal work to try to gain such basic information. Gun Owners of America has more than 750,000 members across the U.S. , including in New York .

The FOILs submitted by SCOPE originated with 33 of its members in Monroe County , who wanted to ask a list of questions around the State Police Field Guide and website. Stephen J. Aldstadt, the statewide President of SCOPE, added, The timing of the Opinion of the Committee on Open Government relative to our filing and service of the court cases to enforce our requests could not be more appreciated. It will underscore for the Supreme Court the appropriateness of our requests.

Ben Carson Tries to Clarify Stance on Second Amendment Rights

Potential 2016 Republican presidential candidate Dr. Ben Carson used a conference call with supporters Wednesday to tackle an albatross that has hovered over him since an interview with Glenn Beck last year, and set things straight on where he stands on Americans' Second Amendment rights.

Carson, who caused a furor last year when he told Beck that people's right to own a semi-automatic weapon depends on where they live, said on the conference call, "There seemed to be group of people I don't know exactly who they are who seize upon one part of something that I said. Sometimes people just hear one little thing and they don't hear anything else," Bloomberg News reported.

Carson had said to Beck, who asked if people should have a right to own semi-automatic weapons, "It depends on where you live, I think. If you live in the midst of a lot of people and I'm afraid that that semi-automatic weapon is going to fall into the hands of a crazy person, I would rather you not have it. If you live out in the country somewhere by yourself, I have no problem."

"But that is secondary to the desire to always defend the Second Amendment."

He said that if elected, "under no circumstances" would he "allow a bureaucrat to remove any law-abiding citizen's rights for any kind of weapon they wanted to protect themselves," including semi-automatic and fully automatic firearms, Bloomberg reported.

It's not the first time Carson has corrected himself over the Beck interview. At the Western Conservative Summit 2014 in Denver in July, he said that the Second Amendment is "vitally important and I would never compromise the Second Amendment in any way. It was put there for a very specific reason, so that the people could act in support of the military in case of an invasion but, more importantly, so that people could protect themselves from an overly aggressive government if that ever happened.

"So we absolutely cannot compromise that because all we have to do is look back through history and see what happened when various dictators rose to power. One of the first things they always did was confiscate the weapons.

"We dont ever want to allow that situation to occur. We dont even necessarily want them to know who has weapons. You have a right to have weapons."

Voter Fraud & The Second Amendment Remedy – Bearing Arms

When I instruct at Project Appleseed eventssomething I dont get to do as often as I would likethe shoot boss typically gives a benediction, reminding us of the bloody sacrifices that that first generation of Americans made in order to win a liberty we all too often take for granted.

One of my favorite shoot bosses typically wraps up his benediction by noting through a voice strained with emotion that, the Founders were forced to use the cartridge box, and risked their lives and sacred honor, to win us the liberty to use the soap box, the ballot box, and the jury box.

The jury box ensures a fair trial by our peers. the soapbox is, of course, the freedom of speech. the ballot box is our right to vote and elect our leaders in fair and free elections.

Unfortunately, all four of those boxes seem to be under attack.

James OKeefe and Project Veritashave unveiled irrefutable evidence today that Democrats across my native state of North Carolina are rabidly in favor of supporting voter fraud in order to win elections, including the North Carolina senate race between incumbent Kay Hagan and challenger Thom Tillis.

It is stunningly obvious that North Carolina Democrats today are eager to facilitate felonies in order to size power, and they think nothing of invalidating the votes of lawful American citizens.

Sadly, this isnt remotely unusual.

Voter fraud in neighboring Tennessee just a half century ago resulted in fed-up voters returning to the cartridge box to restore order from attempted tyranny in what became known as the Battle of Athens.

American citizensmany of whom had just returned form fighting the Germans and Japanesehad to take up arms against an attempt by McMinn County Democrats who literally attempted to steal an election by taking ballot boxes at gunpoint.
