Obama directs overhaul of overtime pay rules- Biz group: Expansion means fewer jobs

President Obama on Thursday directed an overhaul of overtime pay rules, in a move to allow potentially millions more workers to qualify for time-and-a-half pay.

Business groups already are warning the decision could backfire on workers, but Obama pledged to work with both businesses and workers as the new rules are crafted.

"We've got to build an economy that works for everybody, not just for a few," he said. "Today, I'm gonna use my pen to give more Americans the chance to earn overtime pay that they deserve. ... If you have to work more, you should get paid more."

Obama signed a presidential memorandum directing the Labor Department to propose rules that expand the number of employees who benefit from overtime pay.It marked one of Obama's widest-reaching executive actions so far.

The rules would be aimed at salaried workers who make more than $455 a week and those who are ineligible for overtime because they are designated as management even though their supervisory duties are minimal.

The rules do not require congressional action but could take more than a year to implement.

Obama has put a focus this year on increasing worker pay, including a call for Congress to increase the federal minimum wage from $7.25 an hour to $10.10. He also issued an executive order requiring federal contractors to abide by the higher minimum wage.

In his memorandum, Obama directed the Labor Department to recommend new regulations that could increase the salary threshold for overtime eligibility and to change the definition of what constitutes a supervisor.

Obama's attention to overtime dovetails with his emphasis on correcting wage disparities, a theme that he has said will be central to the remainder of his presidential term. It also serves his political ends during a midterm election year, giving him a populist issue along with his calls for a higher minimum wage and better pay for women.

The salary-per-week limit separating those who get overtime and those who don't was increased to $455 in 2004 during the Bush administration. At the time, it hadn't been increased since the mid-1970s.

Obama seeks to change overtime

On Thursday, Obama will ask the Labor Department to look at regulations for overtime, and whether to hike the salary threshold above which employers are not required to pay overtime. The threshold was last raised in 2004 to $455 per week.

It is another in a series of measures Obama is promoting ahead of November midterm elections as Democrats try to appeal to voters and keep control of the Senate.

Obama has been campaigning to boost the minimum wage to $10.10 per hour from $7.25, a measure that stands little chance of passing Congress. He also has tried to urge Congress to extend unemployment insurance benefits for people out of work for extended periods.

"Some employers classify workers as 'white collar' workers even though the overwhelming majority of their duties are not white collar," a White House official said on condition of anonymity, using the example of a convenience store manager or shift supervisor at a fast food restaurant.

"It's even possible that some of these workers make less than the minimum wage per hour," the official said. A salaried worker earning $455 per week who works 63 hours or more earns less than the minimum wage.

The federal standard applies in New Jersey and Pennsylvania. California has a higher threshold of $640 per week and is set to boost that to $800 per week in 2016, while New York set its threshold at $600 per week, increasing to $675 per week in 2016, the White House official noted.

Obama Signs Memo to Strengthen Overtime Pay Rules

Seeking to influence workers' incomes where possible, President Barack Obama signed a presidential memorandum Thursday directing the Labor Department to devise new overtime rules that would make more workers eligible for time-and-a-half pay for their extra hours of work.

The memorandum was one of the most far-reaching executive actions taken by the president this year. The rules would be aimed at salaried workers who make more than $455 a week and those who are ineligible for overtime because they are designated as management even though their supervisory duties are minimal.

"Unfortunately, today millions of American aren't getting the extra pay they deserve," Obama said during a White House ceremony attended by workers and employers.

The memorandum does not specify what the rules or new salary thresholds should be, leaving the rule-making to the Labor Department. A proposed rule is not expected until the fall.

The memo, however, underscores Obama's pledge to bypass Congress when necessary and act on his own on economic initiatives. For instance, even as he calls for Congress to increase the federal minimum wage from $7.25 an hour to $10.10, he has taken executive action to increase the minimum wage for federal contractors.

Advocates of new regulations on overtime say millions of workers could benefit. Critics say it could overburden companies, especially small business, and actually cost jobs.

At issue in the overtime initiative are regulations that create exceptions to legal requirements that employers pay time-and-a-half for time worked beyond a 40-hour work week. Currently, salaried workers making more than $455, or $23,660 a year, aren't eligible for overtime if some of their work is considered supervisory even though many spend most of their day doing manual, clerical or technical work with few management duties.

"If you're making $23,000 typically you're not high in management," Obama said.

Some labor economists say broadening the universe of workers who can get overtime would increase take-home pay for workers, thus benefiting the larger economy. The new regulations could also encourage employers to reduce overtime work and hire more employees to work the extra hours without having to pay time-and-a-half.

Obama's attention to overtime dovetails with his emphasis on correcting wage disparities, a theme that he has said will be central to the remainder of his presidential term. It also serves his political ends during a midterm election year, giving him a populist issue along with his calls for a higher minimum wage and better pay for women.
