DOT worker breaks law, given ultimatum

MORIARTY, N.M. (KRQE) - Veteran Department of Transportation employee and Torrance County Commissioner Lonnie Freyburger is stuck between a rock and a hard place.

Freyburger, who has been a DOT manager for nearly 25 years, has also served on the Torrance County Commission for the last 16 months, which he recently found out was against state law.

"(My supervisor) left a message that said, 'I need to talk with you. It's urgent,'" said Freyburger, who received the message earlier this month. "He told me I had to by the end of the day either resign from the highway department or resign from the commission."

According to State Personnel Director Gene Moser, classified state workers, including most DOT employees, can't hold partisan elected office.

"If they are elected, then by law, they must resign their position from state government," said Moser. "That was the concern to remove politics from the classified act."

Freyburger said he had no idea it was against the law. He told News 13, he got permission from a supervisor last year giving him the okay to sit on the county commission.

State officials said that's not an excuse. Freyburger was placed on paid suspension and given an ultimatum.

"The law is the law," said Adjutant DOT Secretary Mike McEntee. "We have to follow it. We are the government."

McEntee and Moser both said they don't know how Freyburger flew under the radar for more than a year.

McEntee said the department has launched an investigation to find out who allowed Freyburger to hold elected office.

52-Week Low Alert: Green Dot

Shares of Green Dot (Nasdaq: GDOT) hit a 52-week low yesterday. Let's look at how the company got here and if cloudy skies are still in the forecast.

How it got hereWhy Green Dot, a provider of prepaid debit cards, is trading at a new low is a general mystery to me, as the entire credit services sector has been on fire. Credit processors Visa (NYSE: V) and MasterCard (NYSE: MA) have both seen double-digit international transaction growth, while Green Dot's direct prepaid card competitor, NetSpend Holdings (Nasdaq: NTSP) , also logged robust growth with the number of direct deposits climbing by 20%.

Green Dot has been no slouch either. Despite management claiming the company missed its target growth for its most recently ended quarter, Green Dot grew revenue by 26% and non-GAAP income by 40%. The company has also been aggressively adding high-profile companies to its network, including Sears Holdings' Kmart and Rite Aid, which is in addition to longtime partners CVS Caremark, Walgreen, and Wal-Mart.

How it stacks upLet's see how Green Dot compares to its peers.

It appears that investors are anticipating pressure on prepaid debit companies' business from American Express' (NYSE: AXP) entrance into the prepaid market.

Dot Com Pho – Made In The USA Edition

Most of the time, Dot Com Pho Orange County is a sunny outdoor event. Today, it was cloudy with some sprinkles. We thought about moving indoors but decided to have Pho in the rain. It really wasnt that bad. The rain barely hit us, and we were protected by big umbrellas.

We had a nice turn out of a dozen people making it out to the Pho Ba Co patio. Im sure Dot Com Pho Vancouver beat us because the CBC was picking up the food tab for their meetup. If anyone wants to sponsor Dot Com Pho OC, give me a shout, and well give you some nice exposure.

This episode of Dot Com Pho features a shout out, a deadly mix drink, singing Pho in the rain, free noodle fail, Verizon 4G speed test, whos green online, and what could very well be the only technology product that is still hand made in the USA! Amazingly enough, it doesnt cost an arm and a leg. Enjoy!

Local cagers dot all-league teams

'Tis the season for fantasy baseball if you haven't done so already, Freud recommends San Francisco's Madison Bumgarner as a nice addition to your pitching staff but try this on for size.

If you were putting together a fantasy team of local high school basketball, who's your starting five for the boys? There are three strong candidates at point guard alone. Shooting guard? Eagle Valley could put two guys there alone easily, yet Vail Christian has a pretty good two-guard.

Forwards? OMG, as the kids might thumb.

There was no shortage of excellent players both boys and girls locally and the all-league rolls confirm it. We take you through it.

Eagle Valley

The Devils boys got five total selections, but I have two questions. Eagle Valley has only two first-teamers congratulations to Tim Wells and Cooper Senn while Delta had four and Steamboat Springs three? And where in the wide, wide world of sports is point-guard Juan Baca?

Answering the first question, stats are a big part of postseason awards, and Delta's fast-break system produces players with numbers, while the Devils' defense-first makes for a much, more balanced offense. But Steamboat with three guys on the first team from a 5-7 squad and only two from a school that went 10-2 in the Slope and tied for a league title?

Harumph.

Why Baca got no all-league recognition is beyond me. Were the coaches watching the same games I did? You're all-league in my book, Juan.

As for the first-teamers, Wells represents Eagle Valley's deadly perimeter game, and the senior also had a tendency to get hot at the right time ripping off a bunch of points in a very short period of time. Senn is a good selection, even though the numbers probably don't show it. He's a defensive rock.

WASHINGTONShen Yun Performing Arts portrayal of the vast history of China along with its wealth of stories and history enthused audience members who saw it at the Kennedy Center Opera House in Washington D.C. on Sunday, March 25.

Vanessa Allen Sutherland, the Chief Counsel with the Pipeline and Hazardous Materials Safety Administration at U.S. Department of Transportation (DOT), attended the performance, and said it is remarkable.

Mrs. Allen said she loved the costumes, the choreography, and I love the Chinese story-telling thats woven into the performances, adding that the performance mesmerized her.

Shen Yun has said that it aims to bring back the 5,000-year-old culture of China, using performing arts and music as its main mediums of expression.

This is a great opportunity to see a different type of music it is wonderful for me, she said.

While classical Chinese dance is the focal point in each performance, Shen Yun has a unique orchestra that joins together Western and Chinese instruments that plays along with each piece, the companys website states.

And each of Shen Yuns pieces generally have a message or a story that goes along with it, the company states.

I really very much appreciated the fact that the stories have a lesson, but theyre fun and their meaningful and their passionate, Mrs. Sutherland said.

She added, I love the fact that there is a message and a spiritual grounding in these stories It is really remarkable.
