Why Did Trump Tell NSA Chiefs to Deny Russian Plot? – Newsweek

The news that Donald Trump asked the Director of National Intelligence, Daniel Coats, and the director of the National Security Agency, Adm. Michael Rogers, to publicly deny the existence of any evidence of collusion between the Russians and the Trump campaign to influence the presidential election may, or may not, contribute to the overall emerging picture of obstruction of justice by the president.

This revelation underscores several important points about the investigation.

First, as is so often the case in criminal investigations, the devil is in the details. That is particularly true in this case, because the investigation will likely focus on Trumps intent, that is, whether he corruptly attempted to interfere with or impede the FBI investigation, meaning with an improper purpose.

Assessing intent requires a close examination of direct evidence (like Trumps own statements about his intent), and circumstantial evidence (including Trumps actions and words before, during and after the alleged acts of obstruction).

On the face of it, its not evident that Trumps request to Coats and Rogers to comment publicly on the state of the evidence amounts to obstruction. However, according to the Washington Post article , several officials interpreted Trumps request as an attempt to interfere with the investigation.

(That said, NBC News is reporting from a single source that a former official told NBC News that Coats and Rogers did not believe they were being asked to do something illegal. It was more of a public relations request.)

Determining what Trump intended will require establishing and closely analyzing what precisely he said, and the context of his words. Was he clumsily trying to get information out to the public, or was he trying to put pressure on the FBIs investigation?

How others understood Trumps words at the time will often be powerful evidence of how they were intended, but not always determinative.

Second, despite the steady revelations over the last two weeks, there may not ultimately be a smoking gun, a single piece of evidence that definitively establishes Trumps intent.

It is more likely that his intent will be discerned from all the available evidence considered together, in this case Trumps alleged request of then-FBI Director James Comey to declare his loyalty, Trumps privately expressed hope to Comey that he find a way to let the Flynn investigation go, Trumps firing of Comey, the false narrative that Trump created about the firing, Trumps statements to the Russians about dismissing Comey and Trumps own public statements about what he did.

This new revelation about Trumps request to Coats and Rogers, once its details are filled in, will need to be assessed along with all these other pieces of evidence.

Perhaps more damning than the Coats and Rogers revelation, the Washington Post story also contained the following alarming disclosure:

In addition to the requests to Coats and Rogers, senior White House officials sounded out top intelligence officials about the possibility of intervening directly with Comey to encourage the FBI to drop its probe of Michael Flynn, Trumps former national security adviser, according to people familiar with the matter. The officials said the White House appeared uncertain about its power to influence the FBI.

Can we ask him to shut down the investigation? Are you able to assist in this matter? one official said of the line of questioning from the White House.

It is difficult to believe that the senior White House officials referenced here were not being encouraged or directed by Trump to find a way to shut down the FBIs investigation. What subordinates said at the time, how they behaved, and what instructions they received from above will also help establish whether Trump committed obstruction of justice.

Third, there will always be some explanation. Following the revelation that Trump told the Russians that Comey was a nut job and that firing him had relieved great pressure on the President, National Security Adviser H.R. McMaster and Secretary of State Rex Tillerson both labored to offer benign (though notably different) explanations for Trumps words.

It would not be the first time in this affair that administration officials have sought to spin (or lie about) the facts. Investigators, and the public, will need to assess these explanations, relying in part on their common sense, to decide whether they are plausible on their face and how they fit (or dont fit) with all the available evidence.

Finally, it is again worth remembering that the question of whether Trump committed obstruction of justice, to a criminal standard, is just one part of the larger inquiry. The question of criminality cannot be the beginning and end of the investigation.

Important also is to ask whether Trump or any administration officials acted unethically; in violation of rules, regulations, or policy; incompetently; or in a manner that could undermine U.S. security or interests.

The story about Trumps request to Coats and Rogers may contribute to the obstruction inquiry, but it raises many of these other questions as well. For example, the Post cites senior intelligence officials who saw the requests as a threat to the independence of U.S. spy agencies.

For this reason, it is essential that the congressional investigations continue to probe these larger questions and to assess whether personnel, policy, or legislative reforms are warranted.

It may not be the best, but its a great start.

Serato is often seen as an industry standard and has more than a few peripheral companies that make equipment specially paired just for this DJ mixing software. Therefore, it should come as good news that Serato is offering a free DJ program they call DJ Intro. With plenty of file management and integration options, this may be a good intermediate choice, as some equipment may be required to fully utilize this option.

One of the first and still one of the best, Mixxx is a program which is free for both pro and semi-pro users. Not the easiest to learn, this program does have the benefit of a highly active community base which have complied guides and best practices, making getting started easier. Features for this program include hot cues, looping, and parallel visual displays which can contribute to better control of your own beats. Its a bit on the older side, but still allows for superb performance at the best possible price.

If you want to get into DJing as a hobby but have no real plans of investing money towards it, KraMixer may be a good option for you. Florida could pave new changes in ‘stand your ground’ laws – The Seattle Times

TALLAHASSEE, Fla. (AP) Lucy McBath is afraid many more people will die if Florida Gov. Rick Scott signs a bill making it harder to prosecute when people claim they commit violence in self-defense.

She already lost her son, an unarmed black teenager, when a white man angry over loud music and claiming self-defense fired 10 times at an SUV filled with teenagers.

The measure before Scott would effectively require a trial-before-a-trial whenever someone invokes self-defense, making prosecutors prove the suspect doesnt deserve immunity.

Scott hasnt revealed his intentions, but hes a National Rifle Association supporter, and this is an NRA priority.

If it passes in Florida, then they take that same legislation and they push it on the legislative floors across the country, said McBath, whose 17-year-old son Jordan Davis was killed by Michael Dunn outside a Jacksonville convenience store in 2012.

Many states have long invoked the castle doctrine, allowing people to use even deadly force to defend themselves in their own homes.

Florida changed that in 2005, so that even outside a home, a person has no duty to retreat and can stand his or her ground anywhere they are legally allowed to be. Other states followed suit, and stand your ground defenses became much more common in pre-trial immunity hearings and during trials.

The 2012 killing of unarmed teenager Trayvon Martin by neighborhood watch volunteer George Zimmerman opened a debate about the limits of self-defense, and it hasnt let up since Zimmerman was acquitted of second-degree murder after jurors received instructions on Floridas stand your ground law.

Florida Republicans made this bill a priority after the state Supreme Court ruled in 2015 that the defendant has the burden of proof before trial. If Florida starts a national trend to shift that burden to prosecutors, itll be just fine with Republican Rep. Bobby Payne, who sponsored the bill.

Only four of the 22 or more state stand your ground laws mention this burden of proof in Alabama, Colorado, Georgia and South Carolina and all place it on defendants.

Its about following our right of innocent until proven guilty, Payne said. Its about Fifth Amendment rights, its about due process, its about having a true immunity, for when folks really believe theyre in imminent threat of great bodily harm or death, to defend themselves properly.

Senators originally wanted prosecutors to prove beyond a reasonable doubt before trial that self-defense didnt justify a violent crime. The final legislation lowered the threshold to clear and convincing evidence.

Either way, it makes prosecuting violent crimes more difficult, experts say.

I think there will be more false stand your ground claims, said former Broward County prosecutor Gregg Rossman, who has tried 65 murder cases. The pre-trial hearings are very much going to be like a mini-trial.

Proving a killer didnt act in self-defense when there are no living witnesses would be particularly hard, he said: I worry the most about the one-on-one cases. You and I get into an argument and I shoot you. Who speaks for you?

But public defenders say it should help people who were simply trying to defend themselves. Prosecutors often use the threat of minimum mandatory sentences to coerce people into accepting a plea deal even if their use of force was justified, said Stacy Scott, a public defender in Gainesville.

Its going to force them to deal more fairly with citizens who are charged with crimes, and will help our clients either get better plea offers or exonerate themselves earlier in the process so they dont have to wait until a jury trial and risk everything they have in order to litigate their case, Scott said.

McBath, who lives in Marietta, Georgia, believes the guilty will more likely escape convictions. It took two trials to convict her sons killer of murder.

Were just one out of so many, she said. Because we won our case, I honestly, honestly believe thats the reason why theyre putting these additional measures into stand your ground.

Justifiable homicide claims have doubled on average in states that have passed stand your ground laws, said John Roman of the independent research organization NORC at the University of Chicago.

Also, whites who kill black people are 10 times more likely to win a stand your ground claim than blacks who kill whites, said Roman, who analyzed these cases while at the Urban Institute think tank.

Studies also show that white people are more likely to feel threatened by black people than the other way around, and if you then add onto implicit bias the ability to use lethal force, its reasonable then to expect that lethal force will be disproportionately applied to minorities, he said.
