Rape Survivor Explains Why She Supports The Second Amendment [VIDEO] – Daily Caller

On May 12, 2006, Kimberly Corban was asleep in her college bedroom when a complete stranger raped her.

She thought those was her last moments on earth, as he tried killing her soul by brutally assaulting her body. This assault, her 911 calland her decisions afterward changed the trajectory of her entire life.

Now, she believes your greatest courage comes from your worst struggles. She has vowed never to be vulnerable again as she has learned more about self-protection, including how to use a firearm.

With her help and courage, her rapist was caught and convicted in 2007. She has also become a role model and an inspiration to a multitude of other young people who are learning how to protect themselves.

Last week, the head-turning, entrepreneurial TurningPointUSA launched the Trigger Warning Campus Tour, featuring Corban talking about her story and what students can do. Her motto is being a victim is never a choice, but becoming a survivor is.

I dont carry because I worry about what could happen. I carry because I already know.

There are no promises once citizens learn and train how to use a firearm, but the way you train or how much you know or what you choose to carry is going to be one more tool in your toolbox, Corban says. Safety and security are multi-layered, she says, mentioning dogs, security systems, and mace.

The Daily Caller News Foundation filmed Corban at Conservative Political Action Conference after her Armed and Fabulous panel. She spoke along with Kristi McMains, Katie Pavlich, Antonia Okaforand Ashlee Lundvall.

In this interview, Corban tells how she met Kristi McMains, a Louisville attorney attacked in January 2016. The two met in 2016 at the NRA annual meeting. Kristi had been so moved by Corbans story that she began carrying a gun for self-protection only to find within weeks her life was threatened by a man with a knife. Kristi says she was alive because of Corban, who told her story and changed McMains life.

Corban says at the first meeting last year, they ugly cried. Then, at CPAC, Corban was a proud mom hearing McMains tell her story for the first time.

Corban says she avoids movies that glorify rape. She says, what its like to have your soul murdered is never accurately depicted. I dont seek out fictional depictions of it in movies because theres enough of it in real life.

How Pro Gun President Trump Is Wreaking Havoc on Sporting Goods Retailers – TheStreet.com

While U.S. President Donald Trump's vow to "totally" protect the Second Amendment has eased gun owners' worried minds, his lax stance on firearms is causing a negative impact on the outdoor retail industry.

The F.B.I. said it conducted 2.23 million background checks in February, representing a 14% decline from February 2016. Background checks were down 20% in January and 17% in December, as gun owners no longer feel the need to rush to stock up on firearms as they did when former President Barack Obama was pushing for stricter federal gun laws.

During his campaign, Trump was even endorsed by The National Rifle Association (NRA).

But, as gun sales drop, outdoor retailers across the board are feeling the pressure.

Dick's Sporting Goods (DKS) said on its recent fourth-quarter earnings call that its outdoor category was particularly pressured, "driven in part by a decline in hunting."

"We did say that the hunting business was difficult," Dick's CEO Edward Stack said in response to an analyst's question on individual categories. "That hunting business...it continues to struggle and struggled in the fourth quarter, both firearms and a bit from an ammunition standpoint."

Olin (OLN) , owner of Winchester Ammunition, reported a 20% slip in ammo sales in its recent fourth quarter. In a December report, Wunderlich Securities analyst Rommel Dionisio estimated that firearms sales will "likely slow" in 2017. Looks like consumers are proving his prediction right.

Gander Mountain, one of the largest outdoor retailers in the U.S., filed for bankruptcy protection under Chapter 11 on Friday, listing $500 million to $1 billion in assets and liabilities.

Gander Mountain, which touts itself as being "America's Firearms Supercenter," blamed its filing on slowing foot traffic. The company operates about 110 stores in 26 states in the U.S.

To combat its own slipping gun sales, American Outdoor Brands (AOBC) is trying a different tactic in separating itself from the firearms industry. For instance, it changed its name from Smith & Wesson, a brand too associated with guns.

At its investor day in January, American Outdoor said it would be expanding on acquisitions of companies that are not so heavily focused on firearms to create long-term value. The move follows its recent acquisitions of knife maker Taylor Brands and Ultimate Survival Technologies, the manufacturer of survival, rescue, life support and disaster preparedness equipment.

Shares of American Outdoor have fallen about 15% since Trump was elected to office.

Opinion: Florida Supreme Court Rules Open Carry is Not Protected … – PoliticusUSA

In Florida last week while the nation was mesmerized by the non-stop news that Americas government has been infiltrated by Ruskie operatives with a veritable cadre of Russian spies firmly ensconced in the White House, the states Supreme Court upheld as constitutional a Florida law that prohibited open carry of firearms in public. A practice that has been banned since the nations founding and just recently imposed by NRA-indebted Republicans to enrich the gun industry.

The Florida High Courts Justices ruled that the Second Amendment does not protect that ridiculous open carry practice and it was another setback for the NRAs attempts to force the nations courts to abolish any and all firearm restrictions as unconstitutional. The Florida High Court concluded, like many other state and federal courts around the nation, that the Second Amendment cannot be read to prohibit states from regulating the various ways guns are kept and used.

The Court heard the challenge to the Florida statute after a man was arrested and charged with openly carrying a handgun while strolling alongside a U.S. Highway. The ruling began by acknowledging that virtually any adult who has no physical impairment or felony record can carry a gun in public in Florida; it just has to be concealed. It was too much of a restriction for the Florida gun fanatic who had to show off his manhood in public and cried foul. He argued that specifically; the Second Amendment protected his right to openly carry firearms and that the Florida law was an unconstitutional violation of his 2nd Amendment rights.

The man claimed that according to the U.S. Supreme Courts ruling in D.C. v. Heller and McDonald v. Chicago created an individuals right to keep a handgun in the home for self-defense. The frightened gun enthusiast said if an individual has a constitutional right to keep a handgun at home for protection, it is just obvious it also granted him the constitutional right to walk around in public with his gun in plain view for all to see.

The Florida High Court used the exact same analysis deployed by virtually every Federal Circuit Court in considering the NRAs 2nd Amendment challenges to a states firearm rules. The Court asked:

Whether the law burdens conduct protected by the Second Amendment based on a historical understanding of [its] scope, or whether it falls into a historically unprotected category of prohibitions.

The court found that the law did not fall into a historically unprotected category, and instead implicated the central component of the Second Amendmentthe right to self-defense.

The Courts majority quoted an influential law review article and noted what historians, not NRA historical revisionists, have known for a couple of centuries:

[T]he notion of a strong tradition of a right to carry outside of the home rests on a set of historical myths and a highly selective reading of the evidence. The only persuasive evidence for a strong tradition of permissive open carry is limited to the slave South.

In a recent 4th Circuit Court of Appeals ruling, the Court noted that firearm restrictions that fall outside historical protections for the right to bear arms are presumptively constitutional. However, since the concept of open carry has no firm tradition in our legal history, there is more than enough justification for the constitutionality of open carry bans.

Last weeks ruling may not have been a giant win for gun safety advocates, but it was a major defeat for gun fanatics simply because they seem to never lose; at least not any losses the media is willing to report. The Florida Supreme Court decision was handed down barely a few weeks after a 4th Circuit decision ruled that the Second Amendment does not protect assault weapons, and within a year of the 9th Circuit Courts ruling that there is no constitutional right to concealed carry; something that has been widely banned since the nations founding.

As noted by Marc Joseph Stern at Slate, because the Supreme Court clearly has little appetite to expand Heller and McDonald, these decisions will probably stand as the last word on the subject.

Gun safety advocates can possibly take a measure of solace knowing that no matter how remote the chance to achieve much in the way of legislative victories in the NRA-controlled Congress, these few court rulings are highly unlikely to be overturned by the Supreme Court; unless Trump disbands the High Court and replaces it with the governing board of the NRA. It is something that is not remotely implausible.

Armed vigilantes patrol Turkish border to keep migrants out of Europe – Express.co.uk

Disguised in camouflage and balaclavas, and equipped with long knives, bayonets and hatchets, the paramilitary troops hunt down refugees and migrant in Strandzha Massif, a forested mountain range, Bulgaria, on the Turkish border.

Patches on their uniforms a coat of arms displaying a snarling wolfs head framed by Cyrillic text declare they are members of the Bulgarian National Movement Shipka, abbreviated as BNO Shipka.

The group are led by Vladimir Rusev, a former colonel who claims he fought in Chechnya as a volunteer alongside Russians.

Speaking to NBC News, the 58-year-old claims BNO Shipka have as many as 50,000 members in their ranks, however, this figure is unverifiable.

Many of these immigrants are not just some guys who are trying to run away from war. They are from age 17 to 35, with good physiques and training.

Its not a problem that they are Muslims. The problem is its a different civilisation. They dont think like us, they have a totally different view about life, about everything.

The 34-year-old proclaims his beliefs the European migrant crisis was part of a plan to allow ISIS militants to slip into the Continent and allow them to attack.

The BNO Shipka member adds the crisis also allows Turkish troops to be deployed in Bulgaria, under the Nato banner, effectively reclaiming a portion of the lost Ottoman Empire.

The group, despite facing stiff opposition from human rights groups, claim they act within the law, and have unofficial support from Bulgarias official border patrols.

Krassimir Kanev, a founder of human rights group Bulgarian Helsinki Committee, describes BNO Shipka as xenophobic nationalists who are violent, racist extremists.

There are ongoing criminal proceedings against a number of these groups, he said, claiming Bulgarian vigilantes have previously detained migrants, sometimes beating and humiliating them before forcing them back across the border.

Bulgarias caretaker government are set to make a U-turn on laws allowing migrants with the right to asylum and international protections to conclude agreements on integration after public protests.

A government spokesman said they are preparing changes to the regulations and conditions for there integration of migrants and refugees.

The forthcoming proposed changes to the legislation would not be contrary to European regulations and other rules to which Bulgaria is a party to, he added.

In the tiny conference room of a Flemington community center, more than a dozen mothers, some with infants in their arms, sat at a table passing around copies of a legal document Helen Ramirez described as "la carta poder."

Ramirez, an immigration attorney based in Newark, wasreferring to a power of attorney" document. The women watched as Ramirez, working with them pro bono, explained how assigning power of attorney lets unauthorized immigrants assign a caregiver for their child without losing custody in the event they are detained and deported without their children.

As President Donald Trump works to deliver on his promise to deport unauthorized immigrants, many across the country are exploring legal protections to make sure their children aren't abandoned or taken in by the state.

"They're scared of their children winding up adopted by a stranger and then having no control over it,"Ramirez said.

Of the estimated 11.1 million immigrants living illegally in the United States, nearly 4 million have children in the United States.A study of child population from 2009-13 from the Migration Policy Institute, a nonpartisan think tank,states that more than 168,000 children in New Jersey have parents who are unauthorized immigrants9 percent of thetotal child population in the state.

REPORT:Flood insurance fee to pay for border wall

Michele Alcalde, an immigration attorney based in Red Bank, who has advised undocumented immigrants in Asbury Park, Deal and other Shore towns, tells her clients "you have to be a saint nowadays."

She said one client, who immigrated illegally from Honduras 15 years ago, was arrested in February at his residencein Ocean Township by ICE agents who were looking for another target. They didn't find the suspect, but they did learn that the single father had a moving violation and a summons alleging he was driving without a license.

Alcalde says her client is a single father, but his sister was able to step in and care for the child. Other undocumented immigrants who don't have spouses or siblings to care for their children have been reaching out to extended relatives and close friends, especially those with legal status, Alcalde said.

Hans von Spakovsky, a senior legal fellow at the Heritage Foundation, is skeptical that Immigration and Customs Enforcement would deport unauthorized immigrants without giving them the option to take their kids with them. He says parents should leave with their kids, and anyone who doesn't is being neglectful.

"I think there's something frankly wrong with any parents that would abandon their children and leave them in the United States when they go back to their home countries," he said.

An ICE official responding to anemail from the Asbury Park Pressabout their detainment and deportation processstated, "ICE makes custody determinations consistent with controlling law and precedential legal decisions on an individualized basis considering the unique facts of each case.Among other factors, ICE may consider whether the individual is a parent or legal guardian of a U.S. citizen or lawful permanent resident, or the primary care taker of any minor."

In the event families are separated, several immigration lawyers interviewed by the Press said they advised their clients to follow an "emergency plan" released by the Rutgers University Child Advocacy Clinic.See the emergency plan and power of attorney document below:

The plan advises parents to assign power of attorney to a relative or close friend, making them a temporary caregiver without relinquishing custody. The plan also notes that even undocumented immigrants have the right to demand to see a warrant when police show up at their door. It goes on to recommend they make copies of their tax returns and other documents and set aside moneyfor their children if they are separated.

THE TRUMP EFFECT:N.J. companies vying to help design the border wall

Eleana, 23, attended the legal advice session Ramirez held at the Harvest Family Success Centeron Park Avenue in Flemington. She came to the U.S. alone from Honduras in 2013. Today, she has a 2-year-old daughter with her boyfriend, also an undocumented immigrant from Honduras. She was considering assigning power of attorney to her child's paternal grandmother, a legal resident.

"I think it'd be better if she went to live with me ... but it's tough because the country I came from has a lot of economic and public safety challenges. The violence is at its peak," saidEleana, who declined to be identified by her full name for fear of being targeted for deportation.

Eleanaattended a year of college in Honduras, one of the poorest nations in Latin America, and as recently as 2014, was the murder capital of the world. She fled because she couldn't find workand she felt unsafe.

When she arrived in Hunterdon County, she worked a series of jobs until finding regular work as a babysitter.

They planned to raise their daughter in Hunterdon County, where she would live in a safe neighborhood and go to a decent school. Now, the plan is just to extend their stay as long as they can. If they both get deported, Eleana said she wants her daughter's grandmother to put the child on a plane to Honduras to be reunited with her parents.

"You're trying to improve your life and provide your kids a better life," she told a reporter in Spanish. "Now you're in limbo with your kids because parents have to go to work. Kids are afraid because they don't know if their parents will return home at the end of the day."

In states such as California and Massachusetts, unauthorized immigrants with children can leave a close friend or relative in charge of their children without relinquishing custody by filling out a caregiver's authorization affidavit.

New Jersey doesn't recognize the caregiver's authorization affidavit. Until recently, the Garden State didn't appear to offer an equivalent document. But Randi Mandelbaum, a law professor at Rutgers University School of Law in Newark, and a team of lawyers drafted an emergency plan earlier this year. The plan which includes the"power of attorney" document for child custody matters, was disseminatedvia email to immigration lawyers across New Jersey like Ramirez.

Von Spakovsky believes the lawyers and advocates warning families that they could be separated are exaggerating.

"These advocates want to scare people as much as possible because they believe it helps them politically to oppose our immigration law and the president's policies," he said. "I think these advocates are doing a disservice to these aliens and they're doing it for political purposes."

John Leschak,an immigration and family lawyer in Freehold, says Trump's rhetoric about immigrants has sparked a level of fear across the country that at times may be unfounded. He finds it unlikely that both parents in a family would be detained and deported or that it would be as common as some think it would be.

But he also believes unauthorized immigrants are right to make family emergency plans. In fact, he says, they should go beyond assigning power of attorney because there's no guarantee it would be enforceable, though other lawyers say the document likely will be honored by schools and state agencies.

Mandelbaum submitted the power of attorney document she drafted to the Department of Child Protection and Permanency and is waiting to hear if the agency will honor the document.

Leschak recommends parents use aguide prepared by the Appleseed Network, an advocacy group with law centers in the U.S. and Mexico. At 108 pages, it covers everything frombreaking a lease on an apartment to designating power of attorney for a child to filing joint taxes with a spouse even after being deported.

"I don't think you should ever just rely on that piece of paper," Leschak said. "Reality is more complicated than that. I would recommend parents have a more comprehensive plan."
